For over two centuries, courts consistently granted injunctive relief in patent cases, preventing bad actors from profiting off stolen inventions. This system encouraged innovators to invest in groundbreaking technologies and lifesaving therapies.
However, in 2006, the Supreme Court’s decision in eBay v. MercExchange made it significantly harder for patent holders to secure injunctions, upending this longstanding protection. As a result, it’s become much more difficult for innovators–especially small businesses and individual inventors–to stop patent infringement.
